Terms of Service
Last updated: 20 September 2026
These terms govern your use of Toldmark ("we", "us"), the service at toldmark.com.
By creating an account or using Toldmark in any way, you agree to these terms. If you do not agree, do not use the service.
1. What Toldmark does
Toldmark makes a YouTube creator's video archive searchable. It retrieves caption tracks from a connected YouTube channel, processes them, and answers questions about their contents with references back to the source videos.
There are two ways to use Toldmark:
- As a creator, you connect your own YouTube channel and build an archive.
- As a viewer, you follow a link a creator has shared and ask questions about their archive. No account is required.
2. YouTube
Toldmark uses YouTube API Services. By using Toldmark, you agree to be bound by the YouTube Terms of Service.
Google's handling of your data is governed by the Google Privacy Policy. You can revoke Toldmark's access to your Google account at any time at Google's security settings page.
You may only connect a YouTube channel that you own or are authorised to manage. You may not use Toldmark to access, archive, or make searchable any channel you do not control.
We retrieve captions only through YouTube's official API, and we refresh or remove them on a rolling 30-day cycle as YouTube's Developer Policies require. If a video is deleted or made private on YouTube, its transcript, segments and search entries are removed from Toldmark.
Answers that already cited the video keep the citation's title, publication date and link to YouTube.
3. Your account
You are responsible for keeping your password secure and for everything that happens under your account. Tell us promptly if you believe someone else has gained access to it.
You must be at least 16 years old to create an account.
You can delete your account at any time from your profile page. Deletion takes effect after 30 days, during which you can reverse it from your account page or by contacting us.
4. Your content
You keep all rights to your videos, transcripts, and everything else you bring to Toldmark. We do not claim ownership of any of it.
You give us permission to store and process your content only as far as is necessary to run the service: retrieving captions, breaking them into segments, generating embeddings, answering questions, and displaying results. Nothing more.
You are responsible for the content you archive. You confirm that you have the right to connect the channel and archive its contents, and that doing so does not infringe anyone else's rights.
We do not use your content to train AI models, and we do not sell it.
5. What you may not do
Do not use Toldmark to:
- Connect or archive a YouTube channel you do not own or manage
- Circumvent rate limits, usage limits, or access controls
- Attempt to extract source transcripts in bulk, or use Toldmark as a substitute for YouTube's own API
- Republish or redistribute archived transcripts as a standalone dataset
- Break the law, infringe anyone's rights, or harass anyone
- Interfere with the service or attempt to gain unauthorised access to it
If you do any of these, we may suspend or terminate your access.
6. Answers are generated by AI and may be wrong
This matters, so we want to be plain about it.
Toldmark generates answers using AI language models. These answers can be incomplete, misleading, or simply wrong. They may misattribute statements, misrepresent what was said in a video, cite the wrong timestamp, or state something with confidence that is not true.
Toldmark is a tool for finding and navigating content, not a source of truth. Do not rely on its answers for any decision that matters — financial, legal, medical, professional, or otherwise. Always check the cited source before treating an answer as accurate.
We make no warranty that answers will be accurate, complete, or fit for any purpose.
7. Availability
Toldmark is an early-stage product operated by a small team.
We provide it "as is", without any guarantee of uptime, performance, or continued availability. The service may be interrupted for maintenance, may lose data, or may not work as expected.
We may discontinue Toldmark at any time. If we decide to shut it down, we will give account holders at least 30 days' notice by email so that you have time to retrieve anything you need.
We are not responsible for maintaining backups of your data. Your videos and captions remain on YouTube, which is the authoritative source for them.
8. Price
Toldmark is currently free to use.
We may introduce paid plans in future. If we do, we will give existing account holders at least 30 days' notice before any charge applies to them, and you will always be able to decline and stop using the service instead.
9. Shared links
As a creator, you can share a link that gives other people access to your archive.
Anyone with that link can use it. Treat it as public. If you make the archive private again, existing links stop working.
You are responsible for deciding what to share. Questions asked through a shared link are covered by our Privacy Policy.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, or consequential loss arising from your use of Toldmark — including lost profits, lost data, or decisions made on the basis of generated answers.
Where liability cannot be excluded, it is limited to the amount you have paid us in the twelve months before the claim, or CAD $100 if you have paid us nothing.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, these terms do not affect your statutory rights.
11. Ending these terms
You can stop using Toldmark at any time by deleting your account.
We may suspend or terminate your access if you breach these terms, if we are required to by law or by YouTube, or if we discontinue the service.
Sections 4, 6, 10, and 12 survive termination.
12. Governing law
These terms are governed by the laws of British Columbia, Canada, and the courts of British Columbia have jurisdiction over any dispute.
If you are a consumer in the United Kingdom or the European Economic Area, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings there.
13. Changes to these terms
We may update these terms. If a change is significant, we will notify account holders by email at least 30 days before it takes effect. Continuing to use Toldmark after that means you accept the new terms.
